JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-03-2020 The petitioner who is the father-in-law of the informant and grand father of the deceased girl, seeks bail in connection with Sahpur P.S. Case No. 279 of 2019, dated 16.07.2019, instituted for the offence under Sections 201, 302 read with 34 of the Indian Penal Code.

The petitioner is in custody since 17.07.2019.

The informant has alleged in the First Information Report that she was not treated well in her matrimonial home. As part of the aforesaid torture, her one and a half year old daughter is alleged to have been killed by strangulation. All the family members of the husband of the informant including him have been made accused in this case. The post mortem report reveals

Patna High Court CR. MISC. No.78540 of 2019(3) dt.16-03-2020 2/2 that there is no contusion on neck and the death is because of cardio respiratory failure and trauma over head.

It has further been submitted that the deceased, while playing, slipped down from the stairs, which caused her death.

It has further been submitted that the father of the deceased (husband of the informant) has been granted bail by a Bench of this Court vide order dated 28.02.2020 passed in Criminal Misc. No. 11471 of 2020.

Regard being had to the aforestated facts, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Danapur in connection with Sahpur P.S. Case No. 279 of 2019. The application stands allowed.
