2. In the present case, the petitioner seeks bail in connection with Chapra Muffasil P.S. Case No. 388 of 2024, registered for the offences under Sections 341, 323, 324, 307, 354, 379/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and other coaccused persons abused and assaulted the informant. When the mother of the informant came for his rescue, she was assaulted with a knife by the petitioner.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He also submits that the prosecution

No.73505 of 2025(2) dt.11-11-2025 2/3 story is not believable that the petitioner and his entire family came to the residence of the informant and, after hurling abuses, assaulted them with a sword, rod, and danda. The injury report falsifies the allegation of giving a sword blow to any person. Only one injury was found which was on the head of the informant and caused by a hard and blunt substance and this effectively rules out the use of a sword. No specific role has been assigned to any of the assailants. The petitioner is in custody since 02.07.2025 and he has four criminal antecedents, which have all been registered under the Bihar Prohibition & Excise Act. The charge sheet has also been submitted.

5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the submissions of charge-sheet and period of custody, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Chapra Saran in connection with Chapra Muffasil P.S.Case No. 388 of 2024, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
