JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-06-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the opposite party no.2.
The petitioner apprehends his arrest in connection with C.R. Case No.566/ 2017 (CIS)/566/2017 (CR) registered under Section 498(A) of the Indian Penal Code. Learned counsel for the petitioner and the learned counsel for the opposite party no.2 jointly submits that, earlier, the matter was referred to the Conciliation & Mediation Centre, Patna High Court, Patna, for settlement of the dispute in between the petitioner and the opposite party no.2, who are husband and wife, where the petitioner and the opposite party
Patna High Court CR. MISC. No.66437 of 2018(5) dt.17-06-2019 2/2 no.2 appeared and decided to lead their conjugal life together, which would appear from the report dated 22.05.2019 of the Mediator, Conciliation & Mediation Centre, Patna High Court, Patna, flagged at 'B' and the opposite party no.2 has no objection in allowing the prayer of the petitioner for grant of pre-arrest bail.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Madhubani, in connection with C.R. Case No.566/2017 (CIS)/566/2017 (CR), subject to the conditions laid down under Section 438(2) Cr.P.C.
