The petitioner apprehends her arrest in Bajpatti P.S. Case No.220 of 2019, registered under Sections 498(A), 494 and 34 of the Indian Penal Code.

The informant alleged that her husband solemnized second marriage. After 2-3 years of solemnizing marriage, her husband and other family members started subjecting her to different sorts of torture. Petitioner is alleged to have thrown dust of chilli in the eye of the informant.

Learned counsel for the petitioner submits that there is no injury and the allegation is not supported by any medical examination. The petitioner has been made accused in this case only because she is the second wife of Md. Naushad. Learned counsel for the informant as well as learned

Patna High Court CR. MISC. No.68065 of 2019(2) dt.05-11-2019 2/2 APP for the State vehemently opposed the prayer for bail but it appears that petitioner is a lady and her husband subsequently solemnized second marriage with the petitioner and no specific allegation is made against the petitioner.

Taking into consideration the facts aforesaid, let petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Pupari, Sitamarhi in connection with Bajpatti P.S. Case No.220 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
