2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 406/420/34 of the Indian Penal Code.
3. As per the prosecution case, on persuasion of petitioner and co-accused Indu Devi, informant handed over food grains valued Rs. 45,33,254/- to one Satyadarshi @ Sunny and Ajay Kumar Singh but they never returned the same and thus petitioner and other accused persons cheated the informant.
4. Learned counsel appearing for the petitioner submits that the petitioner is merely an employee of ICICI bank and has no concern with the business affairs of his in-laws. Informant has already filed Money Suit No. 10 of 2020 (annexure P 3) prior to institution of the instant case against sole defendant/co-accused Satyadarshi @ Sunny. Petitioner claims

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate IX, Patna in Shastri Nagar Police Station Case No. 488 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
