Mr. Additional Advocate General (9) ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 26-11-2024 The petitioner has filed this writ petition for the following reliefs:

(i) For issuance of writ in the nature of Mandamus commanding the respondents not to construct the building for veterinary hospital on the personal land of the petitioner bearing Khata No.92, Survey No.479 area 2 katha 10 dhur situated in Mouza Khoripakar Kharg, Circle Amnour, Thana No.173, Tauzi Nos.3306, 3307, 3308 under the District Saran at Chapra because as per the Letter No.6 SS(6)10/2023-3754 issued by the Special Secretary, Animal Husbandry and Fisheries

Patna High Court CWJC No.17942 of 2024(2) dt.26-11-2024 2/3 Resources Department, the building for veterinary hospital, Amnour is to be constructed on Khata No.92 Khesra No.173.

(ii) For commanding the respondents not to forcibly construct the building for veterinary hospital, Amnour without any authority on the plot of the petitioner bearing Khata No. 92, Survey No. 479 area 2 katha 10 dhur situated in Mouza Khoripakar Kharg, Circle Amnour, Thana No. 173, Tauzi Nos. 3306, 3307, 3308 instead of making construction on Khata No. 92, Khesra No. 173 which is approved by the Government vide Annexure-2 to this writ application.

(iii) For granting any relief/reliefs to which other the petitioner is found legally entitled to.

2. After some arguments, learned counsel for the petitioner submits that this writ petition may be disposed of with liberty to the petitioner to file a detailed representation for redressal of her grievances before the District Magistrate, Saran at Chapra (respondent no.4).

3. Learned counsel for the State has no objection to this prayer of the petitioner.

4. In view of the submission of learned counsel for the petitioner, this writ petition is disposed of with liberty to the petitioner, as prayed for.

5. On filing of the said representation within four weeks from today, the District Magistrate, Saran at Chapra (respondent no.4) shall dispose of the said representation
