2. The petitioner has prayed for bail in connection with Sadar P.S. Case No. 684 of 2022 instituted for the offence under Sections 147, 148, 149, 341, 323, 307, 302, 504, 506 of the Indian Penal Code.

3. As per allegation in the FIR, when the informant along with his son went to this petitioner for asking his money, in the meantime, the accused persons including the petitioner attacked on them. This petitioner started stabbing upon the chest of the informant's son by means of knife due to which he sustained injury and died during course of treatment.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.77785 of 2023(3) dt.16-01-2024 2/2 petitioner is innocent and committed no offence. He has falsely been implicated in this case. The petitioner has got no criminal antecedent as stated in para-3 of the bail petition and he is languishing in judicial custody since 6.11.2022.

Learned APP appearing for the state has opposed the prayer of regular bail and submitted that the petitioner is named in the FIR who has specifically been alleged to stab upon the deceased Lal Bihari by means of knife due to which he succumbed to injury. The postmortem report of the deceased corroborates the prosecution case and shows several injuries caused by sharp object. It is also submitted that witnesses of the case have supported the prosecution version.

6. Having heard the learned counsel for the parties and considering the nature of allegation, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for bail stands rejected.

7. The trial Court is directed to expedite the trial and conclude the same as soon as possible.
