JUSTICE SHAILENDRA SINGH ORAL ORDER 19-11-2025 The instant writ application has been filed under Article 226 of the Constitution of India by the petitioner seeking the following relief(s):

" A. For issuance of a writ in the nature of certiorari or any other appropriate writ order or direction commanding the Respondents for quashing the order dated 15.07.2025 passed in Jamabandi cancellation Appeal No. 14/2022-23 (Anx-2) passed by the collector cum District Magistrate, East Champaran,

Patna High Court CWJC No.18085 of 2025(2) dt.19-11-2025 2/3 Motihari whereby and where under the District Magistrate dismissed the Appeal of the appellant and upheld the order passed by the D.C.L.R. on 24.05.2022.

B. Any other relief or reliefs may granted in favour of the petitioner as your lordship may deem fit and proper."

2. Mr. Nafisuzzoha, learned counsel appearing for the petitioner and Mr. Vivek Prasad learned counsel appearing for the State-respondents are present and they are heard.

3. The petitioner has challenged the legality of the order dated 15.07.2025 passed by the Collector-cum-District Magistrate, East Champaran, Motihari in Jamabandi Cancellation Appeal no. 14/2022-23 wehreby and whereunder petitioner's appeal was dismissed and order of the D.C.L.R., Areraj, East Champaran was upheld.

4. As the petitioner has an efficacious alternative remedy of revision and further a remedy under the Bihar Land Tribunal Act, so, in view of the availability of these alternative remedies, this court finds no reason to entertain this writ application directly. Accordingly, the present writ application stands disposed of giving the petitioner a liberty to avail the said alternative remedies available to him under the law, if the petitioner avails such remedy in the next four weeks from today,

Patna High Court CWJC No.18085 of 2025(2) dt.19-11-2025 3/3 then the time spent by him in this writ application shall not be taken into consideration while computing the necessary limitation period.
