The petitioner seeks pre-arrest bail in connection with Samastipur Muffassil P.S. Case No. 493 of 2018 registered under Sections 273, 272, 353, 307, 279 and 427 of the Indian Penal Code and Sections 30(a), 36 and 47 of the Bihar Prohibition and Excise Act, 2016.

Considering the allegation against the petitioner that he was carrying huge quantity of foreign liquor and on seeing the police party, he managed to escape but the driver was apprehended and he also disclosed that it was the petitioner, who was owner of the illicit liquor as also the provisions prescribed under sub-section (2) of Section 76 of

Patna High Court Cr.Misc. No.67643 of 2018(3) dt.18-12-2018 2/2 the Bihar Prohibition and Excise Act, 2016, I am not inclined to grant him pre-arrest bail. Accordingly, the application for grant of pre-arrest bail is rejected.
