The petitioner seeks regular bail in connection with Jamui P.S. Case No. 363 of 2020 instituted for the offences punishable under Sections 341, 323, 379, 307 and 504/34 of the Indian Penal Code and Section 27 of the Arms Act. It is a case of shot fired upon the informant by co-accused Neeraj Singh as a result of which he sustained injury on his shoulder and hand and the co-accused persons also snatched a mobile phone of the son of the informant. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that the deposition of the informant, namely, Charitar
Patna High Court CR. MISC. No.79802 of 2023(2) dt.08-12-2023 2/2 Mahto (PW-1) has deposed before the trial Court that some unknown persons who were not the resident of his village and he has also stated that shots were fired from unknown persons and the informant has not named this petitioner in his deposition and co-accused, namely, Ramesh Singh has been granted regular bail by the learned ADJ-II, Jamui in Sessions Trial No.88 of 2022 vide order dated 02.08.2023. Petitioner is in custody since 15.07.2023.
Learned APP for the State opposes the prayer for bail of the petitioner.
Considering the facts and circumstances of the case as well as the submission of the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Jamui in connection with Jamui P.S. Case No. 363 of 2020.
