2. The present petition has been preferred for the grant of following relief(s):

"to direct the Respondent No. 4 to remove the illegal encroachment/construction over public land situated in Mauza- Khanpur, Thana No. 210, Khata (New)-1206, Khesra New5994, 5995, 5996, 5997, 5998 and 5999 under Khanpur Block, Samastipur."

3. At the outset, learned State counsel submits that though the petition before the Collector, Samastipur shows that

Patna High Court CWJC No.17756 of 2025(2) dt.18-11-2025 2/2 allegation has been made that some villagers have encroached the land, they are not in the list of respondents.

4. At this stage, learned counsel for the petitioner submits that he shall be filing a fresh petition before the Collector, Samastipur. However, the fact is that the common pond has been encroached by the people.

5. In this country, specially, the State of Bihar, the ponds are shrinking and is being encroached at every place at the drop of the hat, if the contention of the petitioner is true, the Collector, Samastipur is duty bound to look into the matter.

6. Learned counsel for the petitioner submits that he shall be approaching the Collector, Samastipur with all the relevant documents/photographs to show that it is a pond to be used by the locals but has been illegally encroached.

7. Granting said liberty, the writ petition stands disposed of.
