The petitioners seek bail in a case registered for the offence under Sections 30(a) of the Bihar Prohibition and Excise Act (Amended), 2016.

Learned counsel appearing for the petitioner submits that the petitioners, who are of clean antecedent, are innocent and have not committed any offence. Nothing has been recovered from the conscious possession of the petitioners and the petitioners have no concern with the

Patna High Court CR. MISC. No.74672 of 2019(3) dt.04-12-2019 2/2 alleged recovery. The petitioners are rotting in judicial custody since 19.08.2019.

Considering the facts and circumstances of the case, let the, above named, petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Gaya in connection with Excise P.S. Case No. 537 of 2019.
