JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-09-2020 Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the State as well as learned counsel for the informant through video conferencing. Petitioner seeks bail in connection with Udwant Nagar P.S. Case No. 197/2017 registered for the offences punishable under Sections 302, 307, 323, 341, 324, 447 and 504 of the Indian Penal Code and 27 of the Arms Act.

Petitioner is said to have shot fire upon the informant, who, subsequently, died in course of his treatment. Earlier, the bail prayer of the petitioner was twice rejected by this Court. Submission on behalf of the petitioner is that other coaccused have already been granted privilege of bail by this

Patna High Court CR. MISC. No.75319 of 2019(3) dt.16-09-2020 2/2 Court and petitioner is in jail custody since long. It is, further, contended that on account of land dispute, petitioner has been implicated in this case.

Regard being had to the above-stated facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail.

Accordingly, prayer for bail of the petitioner stands rejected.
