====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 17-01-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

Though in the present case, suspicion is that the recovered liquor was of the petitioner, however, the petitioner has got identical criminal antecedent.

Considering the identical criminal antecedent of the petitioner, I am not inclined to enlarge him on anticipatory bail in connection with Basantpur Police Station Case No. 17 of 2019 pending in the court of learned Additional District & Sessions JudgeII-cum-Special Judge (Excise), Siwan. Hence, prayer for anticipatory bail is refused. In the event of surrender, prayer for regular bail shall be considered without being prejudiced by this order. (Birendra Kumar, J) Kundan/- U T
