The petitioner seeks bail in anticipation of his arrest in connection with Special Case No. 20 of 2018 corresponding to Narpatganj P.S. Case No. 494 of 2018 dated 17.08.2018 instituted for the offences under Sections 21(C)/22 of the Narcotic Drugs and Psychotropic Substances Act.

Two persons viz. Pintu Yadav and Minhaj were arrested and were found to be in possession of 35 cartons containing 160 bottles of 100 ml. each of Cough Syrup. The aforesaid arrested two persons disclosed that those bottles of Cough Syrup were meant to be delivered to the petitioner who had to sell the same as an intoxicating agent.

No.71902 of 2018(4) dt.11-01-2019 2/2 Learned counsel appearing for the petitioner has submitted that the prosecution of the petitioner in the present case is only on the basis of the statement made by the two arrested accused persons. There is no recovery from the petitioner and the petitioner does not have any criminal antecedents.

For the aforestated facts, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Araria in connection with Special Case No. 20 of 2018 corresponding to Narpatganj P.S. Case No. 494 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
