The petitioner is apprehending his arrest in connection with C.R.Case no.1097 of 2017 corresponding to G.R.No.2414 of 2018 , registered for offences punishable under Sections 341, 323, 379, 490(A), 354(B) of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act..
Allegation against the petitioner is that due to demand of motorcycle, he has tortured the complainant and also ousted here from the house.
Submission of the learned counsel for the petitioner is that he is ready to keep her with the dignity and care, however, the learned counsel for the O.P.no.2 has submitted that the petitioner has already married with another lady , as such it will not be proper to live with the petitioner and a maintenance case has also been filed, in which the petitioner has appeared but no
Patna High Court CR. MISC. No.78104 of 2018(5) dt.15-04-2019 2/2 order has been passed.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, surrender before the court below within a period of six weeks from the date of order and on surrender he will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount in connection with C.R.Cae No.1097 of 2017 corresponding to T.R.No.2414 of 2018, subject to condition as laid down under Section 438
(2) of the Code of Criminal Procedure with further condition that he will appear before the learned Family Court as and when required and he will also abide by any direction/interim order or orders given by the learned Family Court. At the same time, Family Court is also directed to pass an order on the interim maintenance within a period of four months. With the aforesaid observation, this application is disposed of.
