JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2019 Appellant apprehends his arrest in connection with POCSO Case No. 41 of 2018, arising out of Brahmpur (Krishna Brahm) P.S. Case No. 366 of 2018 registered for the offences under Sections 323, 379, 441, 354B, 509/34 of the Indian Penal Code and Sections 3(i)(r)(ii), (iii) and (v) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and Sections 4/8 of POCSO Act.

Allegation against the appellant is of trying to outrage the modesty of the informant and one of the co-accused, who was caught hold by mother of the victim girl, managed to escape after snatching ear ring of her mother.

Submission of learned counsel for the appellant is that he has falsely been implicated in this case and now compromise has been arrived at between the parties.

Patna High Court CR. APP (SJ) No.4253 of 2018(4) dt.16-01-2019 2/2 Heard learned Special P.P. also.

In the facts and circumstances, let the appellant surrender within a period of six weeks from receipt of this order and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.
