2. This is the second attempt for bail of the petitioner as earlier such prayer was rejected by order dated 25.09.2024 in Cr. Misc. No. 54586 of 2024.

3. The petitioner seeks bail in connection with Bind P.S. Case No. 145 of 2023 registered for the offence punishable under Sections 341, 323, 354, 307, 379, 504/34 of the Indian Penal Code.

4. Earlier, the bail application of the petitioner was rejected only on the submission made by learned counsel for the informant that the trial had started.

5. Learned counsel for the petitioner has submitted that the learned counsel for the informant had made a false submission before this Court which led to the dismissal of the

Patna High Court CR. MISC. No.81120 of 2024(2) dt.18-12-2024 2/2 bail application of the petitioner.

6. Learned counsel for the petitioner has produced the deposition of P.W.-1 from which it will appear that the witness has been examined on 12.11.2024 and not on 25.09.2024.

7. As per the prosecution case, the petitioner is an accused of assaulting the injured with spade causing multiple contusion. The petitioner is in jail since 04.06.2024.

8. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

9. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-IIIrd, Nalanda at Biharsharif in connection with Bind P.S. Case No. 145 of 2023, subject to the condition that the petitioner will co-operate in the trial.
