2. Lastly, the prayer for bail of petitioner was rejected, vide order dated 02.08.2023 passed in Cr.Misc. No. 38260 of 2023.
3. Trial Court report reveals that the case is still pending for argument on a petition filed under Section 311 Cr.P.C. on behalf of prosecution.
4. Learned counsel for the petitioner submits that out of six accused, except petitioner, other five co-accused persons have already been granted by co-ordinate Benches of this Court, vide orders annexed as Annexures P/6 to P/8 to the 2nd supplementary affidavit filed on 27.01.2025 on behalf of petitioner. He further submits that petitioner's name surfaced on
Patna High Court CR. MISC. No.80220 of 2024(3) dt.04-04-2025 2/2 the confessional statement of co-accused Amit Kumar, who has been granted bail, vide Annexure P/7. Petitioner has got clean antecedent and is in custody since 10.09.2020.
5. Learned A.P.P. for the State vehemently opposed the bail petition.
6. Considering the period of custody, tardy progress of trial and the fact that all other co-accused persons have already been granted bail, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - I, Siwan in connection with Ander P.S. Case No. 146/2020 (Prabhat Kumar Singh, J) Anay U T
