JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Petitioners are in jail custody since 13.09.2019 on the accusation that Nepali liquor was recovered from their possession.

Submission on behalf of the petitioners is that the petitioners do not have any criminal antecedent and even if, the prosecution story assumed to be true, then also, near about 36

Patna High Court CR. MISC. No.67072 of 2019(2) dt.04-11-2019 2/2 litre Nepali liquor is said to have been recovered from their possession for which petitioners are in jail custody since long. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Araria in connection with Special Case No. 1207 of 2019 arising out of Sikti P. S. Case No. 155 of 2019.
