2. The petitioner has preferred this application for grant of regular bail in connection with Jandaha P.S. Case No. 219 of 2025 registered for the offences punishable under Sections 123, 103, 238 & 3(5) of the B.N.S.

3. As per the prosecution case, the son of the informant was suspected to have been killed by his in-laws' family by administering poison.

4. Learned counsel for the petitioner has submitted that the petitioner happens to be the father-in-law of the deceased and has falsely been implicated in this case. It has further been submitted that the petitioner is not named in the FIR and his name has transpired in the confessional statement of

Patna High Court CR. MISC. No.74153 of 2025(8) dt.06-05-2026 2/3 co-accused Budhani Devi, made before the police while in police custody, which has got no evidentiary value in the eye of law. It has next been submitted that no external or internal injury was found on the person of the deceased and the opinion regarding cause of death was kept reserved till the FSL report of viscera examination. It has been further submitted that the FSL report was called for by the order dated 10.03.2026, indicates that no Metallic, Alkaloidal, Glycosidal, Pesticidal and Volatile poison could be detected in the contents of plastic jar. It has also been submitted that there is no eye witnesses to the alleged occurrence of murder, the charge sheet has been filed in this case and there is no allegation of tampering with the evidence. Lastly, it has been submitted that the petitioner has got no criminal antecedent and is in custody since 25.05.2025.

5. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner.

Heard the parties and perused the record, the petitioner above-named is directed to be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Vaishali at Hajipur, in connection with Jandaha P.S. Case No. 219 of 2025.
