The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 363 and 366/34 of the Indian Penal Code.

Allegation against the petitioner is that he abducted to the wife of the informant. The victim is aged about 18 years. The petitioner is relation of the victim.

Submission is that there is matter of some previous affairs between the two which would be evident from the joint photograph of the two enclosed with the bail petition, though the victim has alleged kidnapping and physical abuse by the petitioner but subsequently the parties have entered into the compromise.

No.65747 of 2018(3) dt.09-01-2019 2/2 Considering the entire facts of this case which inclines previous affairs, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Civil Lines Police Station Case No. 224 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
