At the very outset, the learned counsel for the petitioners seeks permission to withdraw this anticipatory bail petition with respect to petitioner No. 1, as he has been arrested during the pendency of this bail petition.

Permission is granted. The anticipatory bail petition with respect to petitioner No. 1 is dismissed as withdrawn. The rest petitioners apprehends their arrest in connection with Matihani P.S. Case No. 144 of 2022, registered for the offences punishable under Sections 323, 341, 307, 379, 504/34 of the Indian Penal Code.

No.74616 of 2022(2) dt.02-02-2023 2/2 The learned counsel for the petitioners has submitted that there is no allegation to assault against the petitioner no. 2 and the injuries are simple in nature. He has also submitted that the petitioner no. 2 is a person of clean antecedent. Considering the above-mentioned facts and circumstances, let the petitioner no. 2, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai in connection with Matihani P.S. Case No. 144 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C.
