Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 80 and 3(5) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that his daughter was married to Raju in the Year 2019, after marriage the accused persons used to torture his daughter for dowry, further two years back the accused persons had assaulted the victim and had ousted her from the matrimonial home for which an FIR was instituted by his sister-in-law (Kusum), next alleges that accused persons used to call him and Kusum and demanded dowry, next alleges that on 27-6-2025 he

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that informant is not an eyewitness to the occurrence and the entire allegation hinges around suspicion. It is further submitted no doubt allegation of dowry demand is alleged, but then the same is general and omnibus in nature. It is submitted that from perusal of the postmortem report annexed as annexure-2, it would manifest that the same records - the death as suspected suicide. It is also submitted that whenever any dispute arises in between the husband and the wife and the occurrence of the nature as alleged takes place, the entire family members are implicated in a a mechanical manner with general and omnibus allegation.
It is also submitted that had the family members including the petitioner been involved in the occurrence, in that event, efforts would have been made to dispose of the dead body with a view to conceal the evidence, but then the dead body was sent for post-mortem for ascertaining the cause of death. It is submitted that petitioner will not abscond rather will cooperate in the investigation to prove his innocence.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Khusrupur P.S. Case No. 235 of 2025, subject to the conditions as laid down under Section 482 (2) of the BNSS.
