The petitioner apprehends his arrest in a case registered for the offences punishable under Section 379 and other sections of the Indian Penal Code.

As per the prosecution case, while the informant was cooking food in her courtyard this petitioner entered into her courtyard and started abusing the informant due to previous enmity. On protest, this petitioner called other family members and started assaulting her by fist and slaps. It is further alleged that this petitioner assaulted the informant with sharp cut weapon causing cut injury. Co-accused Ramesh Kumar snatched ornaments of the informant.

No.3748 of 2023(2) dt.03-04-2023 2/2 It is submitted that both parties are Gotia and due to previous enmity between the parties, an altercation took place in which informant sustained injury. Rest of the allegation are super addition. The doctor has found the injury simple in nature. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in connection with Kalyanpur P.S. Case No. 175 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
