2. The petitioner seeks regular bail in connection with Rupaspur P.S. Case No. 342 of 2024 registered for the offence punishable under Sections 30 (a) of the Bihar Prohibition of Liquor and Excise Act.

3. As per prosecution case, on secret information that the petitioner is involved in business of selling liquor, the police recovered 65 litres of illicit liquor from the hut of petitioner, however, the petitioner managed to fled away.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He further submits that the petitioner has surrendered before the learned trial court in compliance of the order dated

Patna High Court CR. MISC. No.81181 of 2024(2) dt.22-11-2024 2/2 04.09.2024 passed in Cr. Misc. No. 56194 of 2024. Petitioner is in custody since 09.09.2024, having four criminal antecedents. Petitioner undertakes to cooperate in the investigation and will not involve in such type of activity in future.

5. Learned APP appearing for the State has opposed the prayer for regular bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Excise Judge, Danapur, in connection with Rupaspur P.S. Case No. 342 of 2024, subject to the further conditions laid down in Section 438 (2) of the Code of Criminal Procedure, 1973 and further condition that the petitioner shall be properly represented on each and every date fixed by the Court.
