JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-01-2019 The petitioners seek bail in anticipation of their arrest in connection with Kartahan P.S. Case No. 40 of 2018 dated 11.06.2018 instituted for the offences under Sections 147, 148, 448, 341, 323, 324, 333, 504, 506 of the Indian Penal Code.
With regard to some dispute over construction of parapet in the house, an occurrence took place for which the present case has been lodged. The petitioners are neighbours of the informant.
The learned counsel for the petitioners has submitted that some of the accused persons of this case have been granted anticipatory bail by a Bench of this Court
Patna High Court Cr.Misc. No.71227 of 2018(3) dt.09-01-2019 2/2 vide order dated 18.12.2018 passed in Cr. Misc. No. 71387 of 2018.
Regard being had to the aforesaid facts as also taking into account the clean antecedents of the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(ten thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-2, Hajipur, Vaishali in connection with Kartahan P.S. Case No. 40 of 2018, subject to the conditions laid down under Section 438 (2) of the Cr.P.C.
