1. Heard the parties.

2. The petitioners apprehend their arrest in connection with Fatuha P.S. Case No. 483 of 2021 dated 01.07.2021 registered under Sections 447, 341, 323, 332, 353, 186, 504 and 506 of the I.P.C.

3. As per the F.I.R. on 27.06.2021 in the afternoon the petitioners visited the State Bank of India, Fatuha, abused the Bank Officer and snatched notice from the informant's hand, which has been recorded in the CCTV footage. The petitioners also created nuisance / disturbance in the Bank. It has been alleged that the petitioner no. 1 had taken KCC loan from the

Patna High Court CR. MISC. No.78764 of 2024(2) dt.27-11-2024 2/3 Bank amounting to Rs. 45,594/-, for which legal notice was sent.

4. Learned counsel for the petitioners submits that the petitioner no. - 1 is the father and the petitioner no. - 2 is the son. After receipt of legal notice for payment of outstanding loan amount of Rs. 45,594/-, the petitioners went to the Bank to enquire about the correctness of the legal notice inasmuch the petitioners never applied for KCC loan and loan has been obtained fraudulently in the name of the petitioner no. -1. During enquiry some hot exchange took place between the Bank official and the petitioners. The petitioners have lodged Fatuha P.S. Case No. 486 of 2021 against the informant and other Bank officials for creating fake loan in the name of petitioner no. 1.

5. Regard being had to the submission made by the parties, taking into consideration nature of allegation and the fact that petitioners have lodged F.I.R. in the matter, as such, I am inclined to grant anticipatory bail to the petitioners.

6. Let the petitioners, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of
