JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 31-01-2020 Heard learned counsel for the petitioner, learned counsel for the complainant and the learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Complaint Case No. 1243 (C) of 2019 for the offence under Sections 406 and 420 of the Indian Penal Code. The accusation is that petitioner took Rs. Six Crore five lakhs from the complainant to sell his land, but after much pursuation, the petitioner did not execute the sale deed, while petitioner put his signature on the receipt about receiving money.
Learned counsel for the petitioner submits that, in fact, petitioner has not taken money from the complainant to sell the land, but with ulterior motive, the petitioner has falsely

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Begusarai in connection with Compliant Case No. 1243C of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
