2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 191(2), 191(3), 90, 126(2), 115(2), 118(2), 109, 103(1) and 61(2) of the BNS and Section 27 of the Arms Act.

3. The prosecution case, in brief, is that on 24.05.2025 the petitioner along with other co-accused persons came on two vehicles with rifle, pistol and fired on Sunil Singh, Vinod Singh, Virendra Singh, Pujan Singh and Mantu Singh due to which Sunil Singh, Vinod Singh and Virendra Singh died on the spot.

4. Learned senior counsel for the petitioner submits

Patna High Court CR. MISC. No.75365 of 2025(2) dt.18-11-2025 2/2 that the petitioner is not named in the FIR. The name of the petitioner surfaced on the confessional statement of the coaccused persons.

Learned counsel for the informant opposes the prayer for bail and submits that although the petitioner is not in the FIR but there is sufficient material against this petitioner that on the fateful day of occurrence, he along with other co-accused persons came on two vehicles armed with rifle, pistol and other fire-arms and shot Sunil Singh, Vinod Singh, Virendra Singh, Pujan Singh and Mantu Singh due to which Sunil Singh, Vinod Singh and Virendra Singh died on the spot and apart from that the petitioner carries four criminal antecedents. Hence, he does not deserve the privilege of anticipatory bail.

6. Considering the nature and gravity of allegation, prayer for pre-arrest bail of the petitioner is rejected (Prabhat Kumar Singh, J) AjayMishra/- U T
