The petitioner is an accused in a case registered for offence under section 392 of the Indian Penal Code. As per the F.I.R., three unknown miscreants entered into the counter of the Petrol Pump covering their face and committed robbery of Rs. 26,000/- on the points of weapons and thereafter fled away by a motorcycle towards Nawada Road. Learned counsel for the petitioner submits that the petitioner is not named in the FIR and nothing incriminating has been recovered from his possession. Petitioner has not been put on test identification parade (TIP) till date. Petitioner is in custody since 22.06.2019. Similarly situated co-accused Mithilesh Yadav has already been allowed bail by a bench of this Court vide order dated 13.08.2019, passed in Cr. Misc. No. 48900 of 2019. Charge sheet has also been filed in the case. In view of the aforesaid submissions, let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the JM 1st Class, Jamui in

(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case the prosecution will be at liberty to move for cancellation of bail.
