In this case, the petitioner is seeking bail in connection with POCSO Case No. 26 of 2019 arising out of Jamui P.S. Case No. 426 of 2018 registered for offences under Sections 366A/34 of the Indian Penal Code and later on added Section 376(2)(G) of the Indian Penal Code as also Section 4 of the POCSO Act.

In the present case, an allegation has been made that the accused persons kidnapped the daughter of the Informant forcibly, whereafter, the statement has been made by the victim girl stating that she was put to gang rape.

Patna High Court CR. MISC. No.80861 of 2019(8) dt.12-10-2020 2/2 Looking to the entire facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner, above named, is rejected with a direction to the court below to conclude the trial within a period of one year after the normalcy of the normal court proceedings.
