The petitioner has prayed for bail in a case registered for the offence punishable under sections 341, 307/34 of the Indian Penal Code and sections 27 of the Arms Act. As per allegation in the FIR, on the order of coaccused Lalsaheb Singh, petitioner shot at the son of the informant, namely Horod Singh resulting into gunshot injury in his right thigh.
It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. The alleged occurrence took place at the spur of moment. In para 17 of the case, statement of the injured was recorded in which he has stated that that firing has been made accidentally not

Petitioner and injured are friends and after receiving gun shot injury, petitioner and co-accused Raj Kumar Sah both brought the injured to hospital for treatment. Petitioner is languishing in judicial custody since 27.09.2022. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, West Champaran at Bettiah in connection with Jogapatti P.S. Case No. 402 of 2022.
