The petitioner apprehends his arrest in Surajgarha P.S. Case No.208 of 2019 registered under Sections 279, 308, 353, 379/411 of the Indian Penal Code, under Section 4/40 of Bihar Mineral Minor Concession Act, under Section 4, 6, 8 of Bihar Control of Prevention of Illegal Mining(Transportation and Storage) Act and under Section 15 of Environment Protection Act.

The informant alleged that informant and other police officials were on duty to prevent illegal loading and transportation of sand from Saidpura Daita Bandh check post. The informant saw one tractor coming at high speed. When the informant signaled the driver to stop, the driver tried to dash the police vehicle but the tractor ran over on a Canal.

Patna High Court CR. MISC. No.68484 of 2019(2) dt.08-11-2019 2/2 The learned counsel for the petitioner submits that petitioner is owner of the vehicle and he was not even present on the tractor on the date of occurrence. It was driver who was driving the vehicle rashly and negligently.

Taking into consideration the facts aforesaid and nature of allegation made against the petitioner and the fact that the petitioner is owner of the tractor, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in connection with Surajgarha P.S. Case No.208 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Saurabh/- U T
