The petitioner apprehends his arrest in Narpatganj P.S. Case No.443 of 2019 registered under Sections 341, 323, 325, 307, 354B, 379, 504 and 34 of the Indian Penal Code. The informant alleged that the petitioner threw garbage in his field and when the informant protested, the petitioner began to abuse the informant and called his men and thereafter all the accused persons having armed with different weapons came there. Petitioner is alleged to have assaulted the informant with lathi on his head and sister-in-law of the informant was also assaulted by the accused persons. Learned counsel for the petitioner submits that the petitioner got one lacerated wound on left eyebrow which is simple in nature. The sister-in-law of the informant also got two
Patna High Court CR. MISC. No.68518 of 2019(2) dt.14-11-2019 2/2 injuries which are superficial and simple in nature. The occurrence took place due to land dispute. The case has been compromised between the parties.
Having considered the facts that the occurrence took place due to land dispute and on account of assault made by the petitioner, the informant got simple injury, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in connection with Narpatganj P.S. Case No.443 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
