Petitioners are apprehending their arrest in connection with Kiul P.S.Case No.37 of 2019, registered for offences punishable under Sections 147, 148, 149, 341, 323, 307, 337, 427, 353, 504 and 506 of the Indian Penal Code. Prosecution case is that while the police party tried to intercept the Tractor loaded with sands, petitioners and other named accused persons as well as several unnamed accused persons attacked the police party and snatched the Tractor. Submission of the learned counsel for the petitioners is that though they are named in the FIR along with several

Patna High Court CR. MISC. No.74440 of 2019(2) dt.17-01-2020 2/2 unnamed accused persons but no specific allegation has been attributed against them and they have no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Lakhisarai in connection with Kiul P.S.Case No.37 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
