The petitioner seeks bail in connection with Daudnagar P.S. Case no. 9 of 2018 registered under Sections 30(a), 37(b) (c) of Bihar Excise Prohibition Act-2016.

12 lts. of foreign liquor and 305 lts. of country made liquor is said to have been recovered from the house of Raj Kumar Sao and petitioner who is said to have been running the business of aforesaid liquor was apprehended from the said house. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. He has no concern either with the seized

Patna High Court Cr.Misc. No.12919 of 2018(2) dt.06-03-2018 2/2 liquor or with any business of liquor. He has been falsely implicated in the case merely he happens to be relative of Raj Kumar Sao. The seizure list does not bear the signature of the petitioner. He has no criminal antecedent. He has been languishing in custody since 20.01.2018.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 7th Additional Sessions Judge-cum-Special Judge, Excise, Aurangabad in connection with Daudnagar P.S. Case no. 9 of 2018. (Prakash Chandra Jaiswal, J) rohit/- U T
