02. In the present case, the petitioner seeks bail in connection with NTPC Khaira P.S. Case No. 94 of 2023 registered for the alleged offences under Sections 307, 379, 341, 323, 324, 504, 506, 147, 149, 34 of the Indian Penal Code.

03. As per prosecution case, petitioner other coaccused persons attacked the informant and caused injury to him almost on his whole body. They also threatened the informant and took away his gold chain and ring. Further allegation against co-accused Mangal Singh and Yogendra Singh is that they assaulted the informant agaain with lathi and rod on his back making him unconscious.

04. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.73171 of 2025(2) dt.19-11-2025 2/3 petitioner is innocent and has been falsely implicated in this case and no such occurrence ever took place. Earlier some quarrel took place between co-accused Vicky Singh and the informant and due to this fact, his entire family including this petitioner have been made accused in this case and the petitioner happens to be the father of co-accused Vicky Singh. The injury report does not support the prosecution case as the injuries are pain and swelling over left elbow, pain and swelling over whole head and pain and abrasion over back and complaint of chest pain. From X-ray report was it found that there was fracture of left side 6th rib and nature of injury is grievous. The other injuries are simple in nature.

Learned counsel further submits that the prosecution story is not believable that the petitioner and 6-7 unknown co-accused persons assaulted the informant with lathi, danda, rod and pistol but no visible injury was found on the body of the informant. The petitioner has got no criminal history and is in custody since 18.08.2025. Charge-sheet has been submitted.

05. Learned APP for the State opposes the submission made on behalf of the petitioner.

06. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the

No.73171 of 2025(2) dt.19-11-2025 3/3 general and non-specific nature of allegation against the petitioner and further considering the period of custody of the petitioner and his clean antecedent along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Aurangabad/court concerned in connection with Khaira P.S. Case No. 94 of 2023, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions: (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
