2. Petitioner is in custody in a case registered for the offence punishable under Sections 338, 336(3), 340(2), 340(1), 318(4) and 317(5) of BNS 2023.
3. As per the allegation in the FIR, one stolen motorcycle bearing Reg. No. BR-01-EW-6949 has been recovered from the possession of the petitioner.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He next submits that petitioner has purchased the said motorcycle from a garage owner without knowledge that it was a stole motorcycle and the garage owner told him that he will provide the documents of the said motorcycle later but the same
Patna High Court CR. MISC. No.73954 of 2025(2) dt.19-11-2025 2/2 was not provided by the garage owner. He next submits that petitioner is in custody since 23.07.2025 and has got clean antecedent as stated in para-3 of the bail petition.
5. Learned APP for the State opposes the prayer for Regular bail of the petitioner.
6. Considering the facts and circumstances of the case, submissions made by learned counsel for the petitioner and period of custody of the petitioner and also the fact that petitioner has got clean antecedent, let the above named petitioner be released on bail, on his furnishing bail bonds of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal in connection with Karpi P.S. Case No.141 of 2025 with a condition that petitioner shall remain physically present on each and every date fixed by the learned Trial Court till conclusion of the trial.
