JUSTICE ARUN KUMAR ORAL ORDER 08-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Mojahidpur PS Case No. 235 of 2017 registered under Sections 392 and 411 of the IPC.

The allegation in brief is that the informant parked his truck by side of the road, the petitioner came and snatched his mobile and 3500 rupees, immediately the police turned up and recovered one mobile from the petitioner.

Learned Counsel for the petitioner submits that it is a case of theft and not robbery and the petitioner is in custody since 25.8.2017. Having considered the said facts and circumstances, the petitioner, namely, Sagar Hari @ Pape @ Pepe is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Bhagalpur in connection with Mojahidpur PS Case No. 235 of 2017.
