The petitioner in the present case is seeking regular bail in connection with Andharamath P.S. Case No.65 of 2018 registered for the offence punishable under Sections 363, 366A, 341, 323, 354A and 504 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to land dispute. Learned counsel submits that the petitioner has committed no offence as alleged in the FIR. Learned APP has opposed the prayer for bail.

Considering the facts and circumstances of the case wherein both the parties are gotiyas and it is the submission of the petitioner that on account of a land dispute the present case has

No.70187 of 2019(2) dt.04-12-2019 2/3 been lodged falsely implicating the petitioner and his parents, the allegation against this petitioner is that of forcibly taking away the victim girl but there is no allegation of any indecent act or rape and it is stated in paragraph 14 of the application that in medical examination the doctor has also not found any evidence of rape, there being no such allegation, the victim girl has been married to a family and now the parties have come out with settlement to live peacefully, the petitioner being in custody since 30.07.2019, let the petitioner above named be released on bail on completion of six months of custody on 30th January, 2020 on furnishing bail bond of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Jhanjharpur, Madhubani in connection with Andharamath P.S. Case No.65 of 2018, subject to the condition as laid down under Section 437 (3) Cr.P.C. as under:

(a) that such person shall attend in accordance with the conditions of the bond executed under this Chapter, (b) that such person shall not commit an offence similar to the offence of which he is accused, or suspected, of the commission of which he is suspected, and (c) that such person shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing
