JUSTICE ARUN KUMAR ORAL ORDER 08-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Mahila PS Case No. 39 of 2017 (Pocso Case No. 62 of 2017) registered under Sections 376, 354(C), 506/34 of the IPC and Section 4/6 of Pocso Act.

The allegation in brief is that the petitioner made acquaintance with the informant, established sexual relationship and now forcing her to marry with him and sending vulgar message and photographs on WhatsApp.

Learned Counsel for the petitioner submits that the girl is major, more than 18 years of age, the allegation itself discloses that both were acquainted from before, at best it is a case of outraging modesty, he is in custody since 10.8.2017, has no criminal antecedent and the investigation is complete. Having considered the said facts and circumstances, the petitioner, namely, Vikash Kumar @ Amit @ Vikas Kumar @ Vikas Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each
