JUSTICE ARUN KUMAR ORAL ORDER 08-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Birpur PS Case No. 256 of 2017 (Special Case No. 15 of 2017) registered under Section 414 of the IPC and Sections 20/22 of the NDPS Act. Learned Counsel for the petitioner seeks bail of the petitioner on the ground of parity as one of the similarly situated coaccused Suresh Kumar Singh has been admitted to bail by a coordinate Bench of this Court in Cr. Misc. No. 5238 of 2018 and further submits that the vehicle was of one Ranjit Kumar Yadav and ganja was loaded by one Badri Mehta and the petitioner has no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Binod Kumar Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge -cum- Special Judge Supaul in connection with Birpur PS Case No. 256 of 2017 (Special Case No. 15 of 2017).
