The petitioner is languishing in custody in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 384, 385, 379, 307, 504, 506, 325 of the Indian Penal Code.

The prosecution case is based on a written report filed by the informant alleging therein that on 18.05.2022, while the informant along with his son was in his field, in the meantime, all the accused persons named in the F.I.R including the petitioner came there and started demanding ransom of Rs. 10,00,000/-. The

Patna High Court CR. MISC. No.80501 of 2023(2) dt.15-12-2023 2/3 accused persons also abused and assaulted the informant, his son and other persons, however, the son of the informant managed to flee away.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. Admittedly, no ransom amount was paid to anyone and the petitioner has been implicated in the present case in the background of village politics. The petitioner is languishing in custody since 23.06.2023 and the investigation has been completed and charge-sheet has already been submitted.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-

Patna High Court CR. MISC. No.80501 of 2023(2) dt.15-12-2023 3/3 (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Purnea in connection with Rupauli (Mohanpur) P.S. Case No. 122 of 2022.
