2. The petitioner seeks bail in connection with Sikandara P.S. Case No. 312 of 2024 instituted for the offences punishable under Sections 310 (2) and 317 (3) of the BNS, 2023.

3. As per allegation in the FIR, three miscreants riding on the motorcycles surrounded the informant and snatched his bike, mobile phone, wallet containing Rs. 2,000/-, owner book of the vehilce and ear phone. They also hit the informant with helmet.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case. He submits that petitioner has not been named in the FIR. He further submits that nothing

He next submits that petitioner has not put on Test Identification Parade till date. He lastly submits that the name of the petitioner has been surfaced in this case only on the basis of confessional statement of co-accused, namely, Vipin Kumar and except confessional statement nothing has been attributed against him. Petitioner is in custody since 30.04.2025.

5. Learned APP for the State opposes the prayer for bail.

6. From perusal of the FIR and impugned order of the learned Additional District and Sessions Judge-III, Jamui dated 25.08.2025, it appears that petitioner is not named in the FIR. From perusal of the records, it appears that on the basis of written report of the informant Munna Kumar Yadav, FIR has been registered under Sections 310 (2) and 317 (3) of the BNS, 2023 against six unknown persons and the allegation is of snatching bike, mobile phone, wallet containing Rs. 2,000/-, owner book of the vehilce and ear phone from the informant. The petitioner has been made accused only on the basis of confessional statement of co-accused, namely, Vipin Kumar and except confessional statement nothing has been attributed against him. Patna High Court CR. MISC. No.74238 of 2025(2) dt.19-11-2025 3/3 Chaudhary @ Rakesh Kumar has been granted bail by a Coordinate Bench of this Court in Cr. Misc. No. 61245 of 2025 vide order dated 10.09.2025, so considering all these aspects of the case and submissions of learned counsel for the petitioner, I am inclined to grant bail of the petitioner.

7. Accordingly the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Jamui, Bihar in connection with Sikandara P.S. Case No. 312 of 2024, subject to the conditions:- (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the Court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the Court concerned. (Ramesh Chand Malviya, J) Anand Kr.
