JUSTICE BIRENDRA KUMAR ORAL ORDER 30-03-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are in custody in connection with Kudra P.S. Case No.285 of 2017, a case under Sections 392/411 of the Indian Penal Code.

The petitioners were apprehended soon after they

Patna High Court Cr.Misc. No.9765 of 2018 (3) dt.30-03-2018 P2/ had looted to the informant. The villagers, who had apprehended the petitioners, have supported the allegation against the petitioners. Petitioners are in custody since 24.11.2017. For recovery of fire-arm from the possession of the petitioners a separate case was lodged vide Kudra P.S. Case No.284 of 2017. Considering the entire facts of this case especially completion of the investigation, let the petitioners, above named, be released on bail after framing of the charge or after three months from today whichever is earlier on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Kudra Police Station Case No.285 of 2017, with condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
