====================================================== CORAM: HONOURABLE MR. JUSTICE HARISH KUMAR ORAL ORDER 27-11-2025 Heard learned Advocate appearing on behalf of the petitioner and the learned Additional Public Prosecutor for the State.

2. The petitioner apprehends his arrest in connection with Basantpur (LNG) P.S. Case No. 331 of 2025, registered for the offences punishable under Sections 140(4), 109, 126(2), 115(2), 123, 352 and 351(2) of the Bharatiya Nyaya Sanhita, 2023.

3. The allegation against the petitioner is that he alongwith other accused person by showing pistol kidnapped the informant's son. It is further alleged that the accused person forcibly administered intoxication and also injected, due to which he became unconscious and thereafter all the accused persons brutally assaulted and thrown him in an abandoned

4. Learned Advocate appearing on behalf of the petitioner submitted that on the date of occurrence itself, the son of the informant was recovered and taken for the treatment. However, the injury which is allegedly sustained to him, has been found to be simple in nature, caused by hard and blunt substance, as is evident from the impugned order. The allegation levelled against six named accused persons and two unknown persons is omnibus in nature and, in fact, the name of the petitioners have been implicated on account of previous enmity. There is no eye-witness to the alleged occurrence and the entire prosecution case is based on suspicion as the informant has also not seen the incidence. The petitioner though bears one criminal antecedent, however he is on bail in the said case. Now he undertakes that he will fully cooperate in the proceeding of the case. It is lastly contended that even if the allegation is taken to be true for the sake of argument, the specific accusation has been levelled against other co-accused person of administering injection or narcotic substance.

5. On the other hand, learned Advocate for the State vehemently opposed the pre-arrest bail application.

6. Having considered the submissions advanced by

No.74973 of 2025(2) dt.27-11-2025 3/3 learned Advocate for the respective parties and taking note of the nature of simple injury, coupled with the omnibus nature of allegation against petitioner and others, besides the undertaking, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Siwan in connection with Basantpur (LMG) P.S. Case No. 331 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close family members of the petitioner.
