The petitioner seeks bail in connection with Basopatti P.S. Case No.171 of 2019 registered under Sections 467, 468, 471, 472, 420, 409, 406 and 120B of the Indian Penal Code.
Learned counsel for the petitioner submitted that entire allegations levelled in the FIR as against the petitioner are false. From the order of the Block Education Officer, which is annexed along with the FIR, it will be evident that Mukhiya and Panchayat Secretary were issued notice and they submitted other documents. Patna High Court CR. MISC. No.70973 of 2019(2) dt.04-12-2019 2/2 permitted to work in the school for the period mentioned in the FIR. The contention is that four other persons, namely, Ahmad Hussain @ Md. Ahmad Hussain, Murari Jha @ Murari Kumar Jha, Saroj Kumar Thakur and Md. Anjum Pravez @ Md. Anjum having more serious allegation than the petitioner have already been granted pre-arrest bail by a co-ordinate Bench of this Court vide order dated 02.12.2019 passed in Cr. Misc. No.75137 of 2019.
Learned counsel for the State does not controvert the submissions made by the learned counsel for the petitioner. Regard being had to the submissions made above, the petitioner, who is in custody since 01.09.2019 is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each to the satisfaction of learned ACJM-V, Madhubani in connection with Basopatti P.S.
