JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Chatauni P.S. Case No. 279 of 2019, registered for the offences punishable under Sections 498A, 313, 354B, 328,406/34 of the Indian Penal Code & Section 3/ 4 of D.P. Act. As per F.I.R there is allegation against the petitioner happens to be husband of the informant that he has demanded four wheeler and for that subjecting her to cruelty and also assaulted her during her pregnancy and further allegation is that Bhagina of the petitioner tried to outrage her modesty. Submission of the learned counsel for the petitioner is that she is a stubborn lady. Petitioner ha filed a case for divorce against the informant and after knowing the same fact the present case has been lodged.

Having heard both sides, in view of the allegation as discussed above and materials collected, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned Court below and make prayer for regular bail which shall be considered on the basis of material available on record.
