2. The petitioner has prayed for regular bail in a case instituted for the offence under Section 394 of the Indian Penal Code.

3. As per prosecution, it is a case of commission of robbery in the shop of the informant.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He has committed no offence. The case is registered against unknown and no TIP has yet been conducted by the Police. Nothing has been recovered from the conscious possession of the petitioner. He further submitted that the other co-accused have already been granted bail by Co-ordinate Benches vide orders dated

Patna High Court CR. MISC. No. 81932 of 2023(2) dt.19-12-2023 2/2 28.11.2023, 04.12.2023 and 18.10.2023 passed in Cr. Misc. Nos. 73169 of 2023, 76928 of 2023 and 68093 of 2023, respectively. He is languishing in judicial custody since 01.08.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XIV, Patna in connection with Phulwarisharif P.S. Case No. 1365 of 2022.
